TERMS AND CONDITIONS OF THE PROMOTIONAL CAMPAIGN " TERMS AND CONDITIONS OF THE NICHOLAS DAY PROMOTION -20% ON HAND CARE "

("Statute")

§1. General provisions

  1. These Regulations (hereinafter referred to as the " Regulations ") define the terms and conditions and principles of conducting the promotional campaign called "MIKOŁAJKOWA -20% FOR HAND CARE" (hereinafter referred to as the " Promotional Campaign ").
  2. The Organizer of the Promotional Campaign is Bright Future, a limited liability company with its registered office in Wrocław, address: ul. Duńska 9, 54-427 Wrocław, entered into the register of entrepreneurs maintained by the District Court for Wrocław-Fabryczna in Wrocław, 6th Commercial Division of the National Court Register, under KRS number 0000692159, NIP 5213792944, REGON 368186614, share capital in the amount of: PLN 13,000.00 (hereinafter referred to as the " Organizer ").
  3. The Promotional Campaign will be conducted in the Online Store available at https://yourkaya.pl/ .
  4. In the case of capitalized terms not otherwise defined, the definitions provided in the Online Store Regulations apply .
  5. The Company reserves the right to change the terms, conditions and any other matters related to these regulations, including early termination of the promotion under these regulations.

§ 2. Terms and duration of the Promotional Campaign

  1. The Promotional Campaign runs from December 6, 2024 to December 9, 2024, 11:59 p.m.
  2. Participation in the Promotional Campaign is voluntary.
  3. The Saint Nicholas Promotional Campaign consists of granting the Customer a 20% discount on all products from the Hand Care category (hereinafter referred to as: Products) purchased as part of a single order (the value of the order will be reduced by the aforementioned discount granted). The discount will be calculated after adding the selected Products to the basket and entering the discount code: SANTA20 in the "Add discount code" field. If the Customer does not wish to participate in the Promotional Campaign - they do not enter the Discount Code.
  4. In the case of an active Product Subscription, in order to participate in the Promotional Campaign (use the Discount Code), you must enter the Discount Code in the appropriate field "Add discount code" in your Customer Account panel and select the "Save" option.
  5. The Promotional Campaign covers all products offered in the online store https://yourkaya.pl/ .
  6. The Promotional Campaign cannot be combined with other promotions and discounts, unless the terms of a separate promotion or discount state otherwise.
  7. The discount cannot be exchanged for cash, other cash equivalents or any other form of compensation.
  8. The Customer may take part in the Promotional Campaign multiple times throughout its duration, subject to the provisions of these Regulations.
  9. The Promotion is intended for an adult (i) natural person purchasing products or services in the Store to the extent not directly related to their business or professional activity, as well as (ii) a natural person purchasing products or services in the Store directly related to their business activity, when the content of this agreement indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by them, made available under the provisions on the Central Register and Information on Business Activity (hereinafter referred to as "Consumers").
  10. The method of fulfilling orders covered by the Promotional Campaign and the rules for filing complaints regarding the Product(s) are regulated in the store regulations at: https://yourkaya.pl/rules .
  11. The Organizer is the administrator of the personal data of the Participants of the Promotional Campaign. Detailed rules regarding the processing of personal data by the Organizer are regulated in the Privacy Policy at: https://yourkaya.pl/privacy-policy .
  12. By joining the Promotion, you accept the terms and conditions of the Promotion Regulations.

§ 3. Complaints regarding the Promotional Campaign

    1. The right to file complaints regarding the Promotional Campaign, including those related to the course and organization of the Promotional Campaign, is available to each Participant of the Promotional Campaign. Complaints can be filed electronically in an e-mail message to kontakt@yourkaya.com.
    2. The Organizer recommends that in the complaint, the Participant of the Promotional Campaign indicates his/her contact details, data concerning the subject of the complaint and the date and description of the irregularities, as well as his/her requests in connection with the complaint submitted. The requirements specified in the previous sentence are only a recommendation and do not affect the effectiveness of complaints submitted omitting the recommended description of the complaint. The Organizer will respond to the complaint immediately, no later than within 14 days from the date of filing the complaint. In the event that the complaint requires supplementation, the Organizer will contact the Participant with a request to supplement it using the contact details provided by the Participant and will inform about the new time for its consideration.
    3. The use of the complaints procedure does not exclude other rights of the Promotional Campaign Participant to which he or she is entitled under applicable law.

    § 4. Final provisions

      1. The Promotional Campaign is organised in accordance with Polish law and in Polish.
      2. The Promotional Campaign Regulations are available at: www.yourkaya.pl and at the Organizer’s registered office.
      3. Participants may obtain any additional information regarding the Promotional Campaign via e-mail sent to the following address: kontakt@yourkaya.com .
      4. The Organizer reserves the right, to the extent permitted by generally applicable law, to introduce changes to these Regulations for important reasons such as: the requirement to adapt the provisions of the Regulations to changes in the provisions of applicable law or changes in the interpretation of the provisions of applicable law as a result of court rulings, decisions, recommendations of relevant offices or bodies, preventing violations of the law or violations of these Regulations, changing the method of conducting the Promotional Campaign due to technical or technological reasons, extending the duration of the Promotional Campaign, improving the service for Participants, the need to remove errors and/or clerical errors contained in the content of the Regulations, changing the Organizer's data (including contact details, names, e-mail addresses, updating links included in the content of the Regulations). The changes introduced will not violate the acquired rights of the Participants of the Promotional Campaign. In the event of a change to the Regulations, the Organizer will make the uniform text of the Regulations available by publishing it on the website www.yourkaya.pl. Changes to the Regulations are effective from the moment they are indicated and posted on the website www.yourkaya.pl.
      5. In matters not regulated in these Regulations, the generally applicable provisions of Polish law, including the Civil Code, shall apply.
      6. The Regulations enter into force on the date of commencement of the Promotional Campaign.
